Man gets six years, 10 lashes over drugs

KOTA KINABALU: A jobless man was sentenced to six years in prison and 10 strokes of the cane by the Sessions Court here yesterday for possessing 37.79 grams of syabu.

Judge Azreena Aziz imposed the sentence on Tadih Hassan, 27, after he pleaded guilty to the offence during the continuati­on of trial.

He admitted to having the drugs in his possession beside a restaurant in Bandar Sierra here at 6.30pm on October 31, 2017.

The offence, framed under Section 12 (2) of the Dangerous Drugs Act 1952 and punishable under Section 39A (2) of the same Act, carries life imprisonme­nt or a jail term of not less than five years and whipping of not less than 10 strokes of the cane, upon conviction.

In mitigation, Tadih, who was represente­d by counsel Azhier Farhan Arisin, prayed for leniency on the grounds that he was remorseful and has no previous conviction records.

Farhan informed the court that Tadih who hails from Zamboanga, Philippine­s came to Sabah in 2015 and worked as a constructi­on worker in Tuaran.

He further submitted that Tadih is a divorcee and has a son to support who lives in Zamboanga.

As for the drugs, Azhier said it was meant for Tadih's consumptio­n due to the long hours of working, hence he prayed for another chance and take into account his age.

Meanwhile, deputy public prosecutor Dinesh Raja, prayed for an appropriat­e sentence to be imposed against the accused and informed the court that five prosecutio­n witnesses had already testified during the trial.

The court also ordered Tadih's jail sentence to take effect from the date of his arrest on October 31, 2017.
