Man with bombed fish ordered to enter defence
KOTA KINABALU: A 54year-old man was ordered to enter his defence against a charge of possessing 15 bombed fish by the Sessions Court here on April 29 this year.
Judge Elsie Primus meted out the order on Mansor Ukok when the case came up for decision at the end of prosecution stage.
In her ruling, she held that the prosecution had established a prima facie case against the accused and ordered him to enter his defence.
Mansor was allegedly in possession of the bombed fish inside his Toyota Hilux Vigo along Jalan Kg Tinangol, Matunggong in Kudat at 4.15am on August 12, 2018.
The alleged offence, framed under Section 26(1)(c) of the Fisheries Act 1985 and punishable under Section 25(b) of the same Act, carries a maximum fine of RM20,000 or a jail term of up to two years, or both, upon conviction.
The prosecution had called four witnesses and Mansor opted to testify under oath.
Mansor was represented by counsel Sazalye Donol.
