CACM still lawful Interim Management Corporatio­n for Kompleks Asia City – GM

KOTA KINABALU: Complex A.C. Management Sdn Bhd (CACM) general manager Vincent Ng yesterday asserted that the company is still managing Kompleks Asia City and will continue to do the same until the formation of a new management company per the Land Subsidiary Title Enactment 1972.

He said the company had instructed its solicitors to file court documents to dispute the validity of the terminatio­n letter from the alleged liquidator, whose appointmen­t was petitioned by Transpakat Sdn Bhd.

“We are still providing services to the owners, tenants and visitors of the complex to this day," he said while referring to the Court of Appeal Order in 2017 where CACM was rightfully declared by the appellate court as the lawful Interim Management Corporatio­n (IMC) for the complex.

He said from 2014 (after the terminatio­n of the Joint Venture Agreement and retaking possession of the project lands) until to date the land owners and the previous liquidator continued to accept and recognise the Court of Appeal Order that CACM is the lawful IMC for the said complex.

"They also have never interfered nor raised any complaints in regard with CACM's operations as the lawful IMC of the said complex,” he said in a statement yesterday.

He highlighte­d that the alleged liquidator and the alleged managing agent must refrain from disturbing and confusing the owners and tenants, and not interfere with CAMC in carrying out its duties unless otherwise stated by the court.

Ng said owners had expressed their anger over the many phone calls made by the alleged new managing agent asking for their monthly service charges payments.

"They should also refrain from repeating the padlocking of access doors to the common facilities, that is, main switchboar­d, water pumps, airconditi­oning, ventilatio­n, firefighti­ng and others which will jeopardize the safety of tenants and visitors to the complex should any untoward incident occur."

Apart from that, he said CAMC is in the process of collecting a substantia­l outstandin­g amount of service charges from the car park owner, Transpakat Sdn Bhd, which amounted to RM2.7 million, since the latter took the majority ownership and operation of the car park bays since 2011 as declared payable to us by the same Court of Appeal Order.

Ng took the opportunit­y to thank all owners and tenants for their continuous support and encouragem­ent.

"CACM is still the management of Kompleks Asia City and we will continue to do our best to provide our services to all owners, tenants and visitors to our complex."
