Foreigner jailed 18 years, caned for raping woman

KOTA KINABALU: A man was jailed for 18 years and ordered to be given one stroke of the cane by the Sessions Court here yesterday for raping a 27-year-old woman two years ago.

Judge Azreena Aziz imposed the sentences on Basri Ahailin after she found the accused guilty on a charge under Section 376 (1) of the Penal Code.

The charge carries a jail term of up to 20 years and whipping, upon conviction.

The accused, who was called to enter his defence after the court had on February 4 ruled that the prosecution had established a prima facie case against him, committed the offence at a house in a village here on October 9, 2019.

The prosecution had called seven witnesses to testify against the accused while he was the sole defence witness.

The court also ordered the accused to be referred to the Immigration Department after serving his jail sentence for further action.
