Man fined for possessing diesel exceeding limit

KOTA KINABALU: A Sessions Court here on Wednesday fined a man RM15,000, in default, two months’ jail for possessing diesel which exceeded the limit set under the law.

Mohd Mazlan Emarula, 36, who appeared before judge Elsie Primus, admitted to committing the offence at a fuel station in Penampang on May 19, 2023.

The charge against Mohd Mazlan stated that he had in his possession a total of 6,250 liters of the controlled item in three lorry tanks.

The court ordered the profit from the sale of the diesel amounting to RM13,437.50 to be forfeited as government revenue.

When inquired by the court, Mohd Mazlan claimed that the three lorry tanks were not his and he rented them to supply diesel.

The court further ordered for the vehicles to be returned to the rightful owners.

In pleading for a lenient sentence, the unrepresen­ted Mohd Mazlan said that needed a lot of money to support his whole family.

The accused also said that he wanted to use the money obtained from the diesel sales to support his family.

The judge then explained that was impossible for him to get the money back and the offence he committed was serious.

“You have done a veryseriou­s offence. You had in your possession the controlled item, now you want the profit money back, that is impossible,” said the judge.

In reply, the prosecutio­n pressed for a deterrent sentence and to serve as a lesson to Mohd Mazlan not to repeat a similar offence in future.

The prosecutio­n also applied for the profit from diesel sales be forfeited to the government.
