Man jailed for throwing firecracker at car
KOTA KINABALU: An unemployed man was sentenced to 10 months’ jail and fined RM5,000, in default, three months’ imprisonment by a Sessions Court here on Monday for committing mischief by throwing a firecracker at a woman’s car.
Judge Elsie Primus imposed the sentence on Ak Mahathir Pg Bujang, 40, after he pleaded guilty to a charge under Section 435 of the Penal Code.
The offence carries a jail term of up to 14 years or a fine, or both, upon conviction.
Ak Mahathir admitted to committing the offence in
Beaufort on April 12.
In mitigation, the unrepresented accused prayed for a lenient sentence.
He claimed that he wanted to discuss about their problem with the complainant in this case who is the victim’s husband but he had committed mischief on the car of the complainant’s spouse.
In reply, the prosecution urged the court to impose a deterrent sentence against Ak Mahathir.
The court ordered the accused to serve his jail sentence from the date of his arrest.
Meanwhile, an unemployed man who pleaded guilty in a Sessions Court here to a charge of committing sexual physical assault against his teenage sister, will have his case mentioned back on May 21.
Judge Amir Shah Amir Hassan put off the 30-year-old’s man sentencing at the request of the prosecution.
The prosecution told the court that the victim’s impact statement and her medical report were not ready.
While waiting for the said date, the accused will be further detained in custody under Section 259 of the Criminal Procedure Code.
He had admitted to committing the offence on his 14-year-old sibling at a house in Papar at 10pm between March 9 and 23.
The offence was under Section 14 (a) of the Sexual Offences Against Children Act 2017.
The indictment provides for a jail term of up to 20 years and whipping, upon conviction.
