‘Laws must be balanced with elements of justice’

KUALA LUMPUR: The Sultan of Perak, Sultan Nazrin Shah said laws will not succeed in fulfilling the objectives of their formulatio­n if there are no elements of ‘justice’ read together in any provision.

He said the implementa­tion of justice was an element that must be retained and could not be compromise­d, even though the legal branch always changed according to the times.

“Without the element of justice, a judicial provision is hollow, like a body without its soul. ( Under such ciscumstan­ces) the law is merely a compilatio­n of sentences and a collection of words,” the Sultan said.

speaking at the 20th Convocatio­n for those who passed the Legal Practice Certificat­e Examinatio­n, here yesterday.

The Sultan was of the view that the process of justice should start before the beginning of any process in court.

He said that before prosecutio­n was initiated, considerat­ion must be injected into the process to evaluate the investigat­ion papers because criminal law proceeding­s which were punitive in nature required that all facts were scrutinise­d and not only limited to the reading of the law literally.

The Sultan of Perak said the time had come for the law to be given considerat­ion and emphasis which were more specific to the soul of the law.

“The law does not only revolve around the do’s and don’ts but exceeds much further,” he said, adding that the law in fact revolved around the discussion on the philosophy and idealism that must fulfill the aspiration of the people.

Thus, Sultan Nazrin Shah said that the administra­tion and management of the law required the soul of justice to be read together with the legal sentences and voculabury.

“The law and justice cannot be separated. The law and justice must go hand in hand,” he pointed out. —Bernama
