High Court hears dispute over shop lots
SIBU: The High Court here yesterday heard the dispute over ownership claim of three shop units in Kampung Dato.
The dispute is between Twinswood Sdn Bhd and Sarawak United People’s Party (SUPP).
Judicial Commissioner Dean Wayne Daly presiding over the case, heard three witnesses from SUPP, namely, SUPP Pelawan branch chairman Clarence Ting, Datuk David Teng and SUPP Pelawan branch advisor Dato Ding Lian Cheong.
SUPP Dudong branch chairman Datuk Dr Soon Choon Teck will be called to testify today.
SUPP was represented by counsels Sunny Si, Andin Linton Albert, Tonny Hii and Laura Kong while George Lo and Jonathan Tay represented Twinswood.
On Dec 8, 2016, the Court of Appeal in Kuching unanimously allowed an appeal by Twinswood Sdn Bhd against the default judgment obtained by three top leaders of SUPP over the ownership of the three shop units.
Twinswood filed the appeal against the Sibu High Court’s decision on March 11 last year, dismissing the company’s application to set aside a default judgement with cost of RM5,000.
On Aug 24, 2015, the High Court ordered that the three shop units be transferred to SUPP in a default judgment obtained by the three SUPP leaders.
It is learnt that the property at Kampung Dato, consisting of three shop units titled as lots number 1291, 1292 and 1293, have been registered in the name of a private limited company, Twinswood Sdn Bhd, with 50 shareholders, since 1988.
These shareholders were previously SUPP members.
SUPP filed a suit to claim the property from Twinswood on June 2, 2015 during their party’s anniversary celebration.
