Developers to pay for late delivery of houses

Payments of compensati­ons to claimants must be made within 45 days of the receipt of the written judgement from the Tribunal, and all repair works must be done within 30 days upon notificati­on by claimants.

KUCHING: The Sarawak Housing Purchaser Claims Tribunal yesterday directed two developers to pay house buyers a total of RM57,902.63 for delay in handing over properties to them.

The developers were also told to repair any defects and unsatisfac­tory finishing to the claimants’ houses.

In the first case, Tribunal president Robert Elone Sireng awarded RM1,867 to claimant Ambong Saong for late delivery of his house based on the formula allowed by the Tribunal. Ambong had bought a double storey terraced house in Muara Tuang Land District in Kota Samarahan.

In addition, the developer was told to change the plywood door of the house to timber door as agreed and to repair the rough surface of the floor.

The second case involved five claimants against the developer of a condominiu­m unit at

Jalan Wan Alwi. But one of the claimants, Liew Pit Lin, had withdrawn her claim because she had already been compensate­d, while the Tribunal found no delay in handing over the property to claimant Chiam Chiew Kiat.

However, the developer will have, in accordance with all agreements, to install belian door to the kitchen and install tempered glass.

The Tribunal then ordered the developer to pay RM56,035.63 to the other three claimants, Lee Chia Ping, Wong Hie Eng and Ivan Chen Ee Kang.

Lee was awarded RM16,88.67 compensati­on for late delivery. In addition, the developer agreed to install belian door to the wet areas, tampered glass to the common bathroom as well as make good the rusty railing.

As for Wong, he was awarded RM18,785.82 based on 146 days delay in handing-over of property. The developer wanted to claim for 72 days extension of time due to inclement weather but the Tribunal did not agree because the notificati­on to the buyer was not in accordance with the agreement.

The developer was also told to install belian door to wet areas, tampered glass to common bathroom and make good the rusty railing on the balcony.

And for Chen, the Tribunal instructed that he be paid RM21,161.14 based on 151 days of late delivery.

The developer also claimed 72 days extension of time due to inclement weather but the Tribunal rejected it because the notificati­on to the buyer was not in accordance with the agreement.
