Father gets two years’ jail, whipping for attacking son

KUCHING: A father was sentenced to two years’ jail and ordered to be given two strokes of the rotan by the Sessions Court here yesterday for attacking his son with a meat cleaver last Saturday.

Judge Mohd Taufik Mohd @ Mohd Yusof meted out the sentence after taking into considerat­ion Alias Razali’s guilty plea and appeal in addition to examining the facts of the case, the seriousnes­s of the offence as well as taking into account public interest.

According to him, the sentence was in view that the accused hit the victim simply because the victim had asked the accused to be quiet.

On Jan 4 at 12.45pm, the victim Mohammad Adzhim Mawariq Alias, 25, had asked his father to keep quiet and not to make any noise.

However, this angered his father who then attacked him using the meat cleaver, resulting in the victim suffering injuries to his chest.

The victim lodged a police report on the same day. The incident took place at their house in Kampung Tabuan Haji Drahman, Jalan Foochow here.

For his action, the accused was convicted under Section 324 of the Penal Code which was read together with Section 326A of the same code.

In his appeal, the accused told the court that he had to take care of his ailing wife.

However, Deputy Public Prosecutor Daniel Ilham Kamaruddin asked for a proportion­ate sentence against the accused in view that the offence was serious and the injury sustained by the victim involved the chest area.

In an unrelated case, an entertainm­ent centre supervisor was fined RM2,500 in default five months’ jail by the Magistrate’s Court here yesterday for operating an entertainm­ent centre without a licence.

Mohammed Shariff Mohamad, 24, pleaded guilty to the charge under Section 5(1)(b) of the Entertainm­ent Ordinance 2000 which was read to him before Magistrate Nuruhuda Mohd Yusof.

According to the charge, the accused as an entertainm­ent outlet supervisor had operated an entertainm­ent outlet without a valid licence issued by Kuching South City Council (MBKS).

He committed the offence on Nov 5 last year at 10.20pm at the premises located at Jalan Padungan here.

During the raid, several items such as speakers, computer, monitor and keyboard were seized as case exhibits.

The prosecutio­n was led by prosecutin­g officer Inspector Merylene Lindan Andrew Mang while the accused was unrepresen­ted.
