Jobless man jailed six month for having drugs

MIRI: A jobless man was sentenced to six months’ jail by a magistrate­s’ court here yesterday after he pleaded guilty to a drug possession charge.

Magistrate Nazira Adlin Ahmad Khairul Razi ordered the sentence to run from March 23 the day he was arrested.

Mohd Faizin Jonie, 36, of Kpg Siwak Jaya in Bakam was charged under Section 12 (2) of the Dangerous Drug Act 1952, which is punishable under Section 12 (3) of the same act and Section 12 (2) of the Dangerous Drug Act 1952 and punishable under Section 39A (1) of the same act.

Section 12 (3) provides for a maximum fine of RM100,000, or jail not less than five years, or both upon conviction, while Section 39A (1) provides for a jail term of two to five years and three to nine strokes of the cane, upon conviction.

According to the facts of case, a police party from the Narcotic Crime and Investigat­ion Department detained a man for suspected involvemen­t in drug activities in front of a 24-hour laundry at Jalan Sim Cheng Kay here around 8.30pm on March 22.

During a body search, the police found 10 white plastic packets containing what is suspected to be methylened­ioxymetham­phetamine (MDMA) weighing 300g.

Following his arrest, the suspect led the police to a hotel room in the same area, and there, the police seized a plastic bag from the bathroom. Inside were found 90 plastic packets containing substance suspected to be MDMA weighing 2,900g.

The first exhibits (10 plastic packets) were sent to the Chemistry Department in Bintulu and was confirmed to be methamphet­amine weighing 0.6g.

The second exhibits (90 packets), was confirmed to be methamphet­amine weighing 5.6g.

In mitigation, the accused who was previously detained at Miri Prison for failure to post bail pleaded for leniency saying it was his first offence.

Inspector Mudzilawat­i Abdul Rahman prosecuted while the accused was unrepresen­ted.
