Notify Labour Office when starting business — Department

KUCHING: Individual­s or employers looking to start a business are to provide a notice to the nearest Labour Office as stipulated under Section 60A of the Labour Ordinance (Sarawak Chapter 76), said Sarawak Department of Labour (JTK).

In a statement yesterday, it said the notice must be given within 90 days from the date of starting operations or taking over or changing the name or location of the business concerned.

In addition, it said the 90-day period would also be calculated from the date on which the first employee was employed for the business, whichever was earlier. For any company that had been operating for a long time but had not yet registered, it is advised to register the business as soon as possible at the nearest Labour Office.

“The notice given to JTK Sarawak must be made in writing and submitted to the Labour Office closest to the location of the business. The notice must contain the name of the registered business, the address and type of business, the name of the manager or person in charge and the category and number of employees employed.

“Employers can also submit a notice using form JTKSWK60A which can be downloaded from the website www.jtkswk.gov.my. The JTKSWK60A form can also be obtained from Labour offices throughout Sarawak,” it said.

This is as provided for under Section 60A, which obliges any person or employer who intends to carry on any agricultur­al, forestry or industrial enterprise, or any corporatio­n in which any trade, profession or business is carried on, to give notice to the Sarawak Department of Labour.

In addition, any person or employer who intends to take over or start a business or change the name and location of the enterprise is also required to give such notice.

Any employer who fails to give a notice or gives a notice that contains false details is committing an offence under section 130E(f) of the Labour Ordinance (Sarawak Chapter 76) and upon conviction, can be fined not more than RM10,000.
