Self-employed man jailed a year for mischief

SIBU: A self-employed man, 34, who ran amok was sentenced to two years and five months’ jail by a magistrate­s’ court in Belaga, yesterday.

The accused, Larry Lirong Luhat, who faced three charges was ordered to spend a year in prison by Magistrate Flavian Edward Henry who ordered that three sentence to run concurrent­ly.

He committed the offences at 12.30pm on Oct 20 at a house in Sungai Asap, Belaga.

The first charge was framed under Section 425 of the Penal Code and punishable under Section 426 of the same code for mischief.

The section provides for a maximum five years’ jail or a fine, or both upon conviction.

The second charge was framed under Section 319 of the Penal Code and punishable under Section 323 of the same code read together with Section 326A of the same code for causing hurt to his grandmothe­r. The section provides for a jail term that may extend to one year, or fine up to RM2,000 or both upon conviction.

The third charge was framed under Section 503 of the Penal Code and punishable under second limb to Section 506 of the Penal Code for criminal intimidati­on.

The section provides for a maximum seven years’ jail, or a fine, or both upon conviction.

Larry, who was unrepresen­ted, was sentenced to five months jail for the first charge and one year each for second and third charges.

According to facts of the case, Larry was having a meal with the family when he suddenly ran amok and proceeded to destroy several utensils in the house. He also pushed his grandmothe­r causing her to fall down and hurt herself. His grandmothe­r and grandfathe­r fled to the house next door to ask for help. Shortly afterward, the headman came to resolve the issue.

However, the accused said ‘Jika kamu naik, kamu akan mati’ (if you come up you will die) while holding a machete.

He was arrested at 7.30pm onthe same day after a police report was lodged.
