Court sets date for Nf corp cheating case
KUALA LUMPUR: The Sessions Court has set June 12 to mention the trial of businessman Datuk Shamsubahrin Ismail, who is facing two counts of cheating the National Feedlot Corporation (Nfcorp).
The court also decided to maintain the hearing of the case from July 16 to 27.
Judge Rozilah Salleh set the mention date after DPP Datuk Abdul Razak Musa of the Malaysian Anti-corruption Commission told the court that the Attorney-general’s Chambers had rejected a letter of representation from the defence to review the charges against Shamsubahrin.
The DPP said there were complications involving recent amendments to the Criminal Procedure Code (CPC), adding that he was unsure if the changes would apply to the case.
Rozilah told Abdul Razak to get the relevant information from the Attorney-general, stating that the hearing would start as scheduled on July 16 regardless of the amendments to the CPC.
During proceedings on April 4, Abdul Razak had informed the court that he had received a letter of representation from the defence on March 14 to whether proceed with or drop the charges.
Shamsubahrin, 45, was charged last december with two counts of cheating Nfcorp chairman Datuk Seri Dr Mohamad Salleh Ismail by promising to provide consultation services and advice and dishonestly inducing Mohamad Salleh into handing over a cheque for Rm1.76mil.
Shamsubahrin, who is chief executive officer of Resources Sdn Bhd, faces up to 10 years in prison and whipping as well as a fine for each charge upon conviction.
He allegedly committed the offences at a restaurant in Bukit Tunku here at 6pm on Nov 20 last year and at Mont Kiara between Nov 25 and Dec 6 last year.
Shamsubahrin is represented by Zarina Ismail and Rafiq Rahim.
