SEREMBAN: Three policemen pleaded not guilty at a magistrate’s court here to helping a 39-year-old suspected drug dealer escape while he was being taken to the Simpang Renggam detention centre in Johor.

Kons Nizar Azizi Alwi, 30, was the first to be charged with abetment under Section 109 of the Penal Code by handing over RM1,000 to suspect B. Kishminderjit Singh at the Mantin police lock-up between 11pm on Aug 31 and 3am the following day.

The money was apparently to allow Kishminderjit to bribe two other cops – Kpl Ismail Jamil, 50, and Kons Nashrul Azlan Mohammad, 24 – who had been tasked with escorting him to the detention centre in the morning.

Kons Nizar Azizi faced another count of negligence under Section 224 for allowing Kishminderjit, who was to serve two years at the detention centre, to escape.

Minutes later, Kpl Ismail and Kons Nashrul Azlan were charged with negligence under Section 223 for allowing Kishminderjit to escape from a car park near the Setul rest area along the Seremban-Kajang Expressway between 7.50am and 10.55am on Sept 1.

All three, who are attached to the Mantin police station near here, had been on police bail since the Sept 1 incident.

DPP Nabilah Mohammed Zainuddin asked the court to set bail at RM4,000 with one surety for Kons Nizar Azizi.

However, defence counsel Siti Huzaifah Abdul Talib asked for a lower sum, adding that Kons Nizar Azizi only earned RM1,300 a month while his wife, a nurse, earned RM2,000.

“He also has to provide for his two young children as well as his aged parents in the kampung,” she said, adding that Kons Nizar Azizi had been a policeman for 10 years.

Magistrate Mohamad Izman Mohamed Noh then fixed bail at RM3,000 with one surety.

Nabilah also urged the court to set bail at RM2,000 with one surety each for Kpl Ismail and Kons Nashrul Azlan.

However, counsel Ardelliza Izmaryanti Shafie said Kpl Ismail, who had served the force for 30 years, had to provide for five children and two grandchildren while Kons Nashrul Azlan only got married in March.

“Their wives are not working and Nashrul Azlan only earns about RM1,000 a month,” she said.

Mohamad Izman then set bail at RM1,000 with one surety each and fixed Oct 28 for mention.
