Woman successful­ly sues gynaecolog­ist for leakage suffered in C-section surgery

SHAH ALAM: A lawyer successful­ly sued a gynaecolog­ist for RM165,375.81 in damages for making her suffer from leakage in her bladder and vagina following a Caesarian section surgery four years ago. Noorziana Md Yusof was awarded the sum by Sessions judge Datin Nursinah Adzmi yesterday.

The mother- of- four had undergone the C-section surgery conducted by obstetrici­an and gynaecolog­ist Dr Fatima Najla KM Muhd to deliver her fourth child on Dec 6, 2012.

In her claim filed on Feb 5, last year, Noorziana, 40, stated that Dr Fatima failed to inform her about the negligence during the surgery which caused her urine to turn murky.

She claims that despite repeated enquiries, the doctor failed to address the issue.

She also said that Dr Fatima was neglectful when she cancelled an appointmen­t arranged with a urologist from another private hospital after her cloudy urine had turned clearer.

She claimed that Dr Fatima even discharged her from the ward at 9.30am on Dec 8, 2012.

But things started to worsen after that. Noorziana found out that her condition had deteriorat­ed after which she had to change her sanitary pads five times a day due to uncontroll­ed bladder discharge. Her urine was also tainted with blood.

A CT scan later revealed that Noorziana was suffering from an injury to her bladder wall which forced her to undergo a second surgery at another private hospital to treat the leakage.

“Thank God, I feel very relieved and I hope it will be a lesson in medical negligence cases. I am thankful that it is over now,” said Noorziana who was in tears when talking to reporters outside the court here yesterday.

Her lawyer Azmer Md Saadtold reporters that the judge who handed down the judgment in chambers, had awarded RM100,000 to his client due to the leakage in her bladder and vagina and RM50,000 for the pain suffered.

An additional RM14,675.81 in special damages for the medical bills, and RM700 in travelling expenses and interest and costs were also granted.
