PUTRAJAYA: The Federal Court postponed delivering its verdict on an appeal by former Selangor mentri besar Dr Mohamad Khir Toyo in a corruption case as he is warded at the National Heart Institute (IJN).

The five-man panel, led by Chief Judge of Malaya Tan Sri Zulkefli Ahmad Makinudin, postponed delivering the verdict to Sept 22.

The panel included Justices Tan Sri Ahmad Ma’arop, Tan Sri Hasan Lah, Tan Sri Jeffrey Tan Kok Wha and Datuk Ramly Ali.

“We were ready for decision, for full judgment. But we are not going to deliver it today, we will adjourn it to Sept 22, at 2.30pm. We pray that he will recover, and that he will be all right,” Zulkefli said.

Khir had collapsed while jogging on Wednesday and was taken to IJN.

“He will be undergoing an angioplasty today in IJN,” his counsel Tan Sri Muhammad Shafee Abdullah told the court.

The former Sungai Panjang assemblyman had been found guilty and sentenced to 12 months’ jail for obtaining two plots of land and a bungalow at No. 8 and No. 10, Jalan Suasa 7/1L, Shah Alam from Ditmas Sdn Bhd via its director Datuk Shamsuddin Hayroni.

The properties were bought for RM3.5 million, compared with RM6.5 million paid for it by Ditamas on Dec 23, 2004.

He committed the offence with the knowledge that Shamsuddin had dealings with him in his official capacity as mentri besar.

Khir was found guilty by the Shah Alam High Court on Dec 23, 2011. On May 30 last year, the Court of Appeal rejected Khir’s appeal against his graft conviction.
