WE REFER to “EAIC Proposal Misplaced” (Down2Earth, Dec 15).

The Commission takes note of the article with regard to the complainants David Mauricio Velez Hernandez (ref: EAIC 600 (S)-1/1/2014-98) and Chew Vee Lyn (ref: EAIC 600 (S)-1/1/201499).

Kindly be informed that a full investigation has been conducted and the findings have been presented before the Commission Meeting No. 13/2015 dated Oct 21, 2015. Consequently, the Commission has found that the Immigration Department of Malaysia, Putrajaya has failed to adhere to the proper Standard Operating Procedures (SOP) in regards to the condition of the Putrajaya Immigration Depot and the treatment given to David Velez throughout his detention at the said depot.

In respect of the above, the Commission had decided that a letter to be sent to the direc- tor-general of Immigration Department and the same to be copied to the secretary-general of Ministry of Home Affairs advising for serious and proactive actions to be taken by the Immigration Department to improve the conditions of the depot and also, to improve the treatments given to the detainees to be in compliance with the SOPs.

During the said investigation, the Commission had also conducted a visit to the said immigration depot as part of the investigation process.

Please be advised that upon the decision of the Commission, notification letters dated Dec 9, 2015 and Dec 10, 2015 were sent to the above said complainants respectively.
