Ex-CEO on CBT charge

> Former head of Tabung Haji subsidiary accused of misappropriating RM2.57 million

KUALA LUMPUR: Former chief executive officer of THHE Fabricators Sdn Bhd, Nor Badli Munawir Mohamad Alias Lafti, 50, was charged at a sessions court here yesterday with five counts of committing criminal breach of trust (CBT) involving RM2.57 million in 2013.

THHE (Tabung Haji Heavy Engineering) is a subsidiary company of Lembaga Tabung Haji.

Nor Badli, who is currently a director of his own investment company, is alleged to have committed the offence at THHE Fabricators office, 23rd floor, Tower B, Menara UOA, Bangsar, No. 5, Jalan Bangsar Utama 1, between April 2013 and October 2013.

The charges are under Section 409 of the Penal Code, which is punishable with between two and 20 years’ imprisonment, whipping and a fine. He claimed trial to all the charges. Sessions court judge Madihah Harullah granted RM400,000 bail with one surety and ordered Nor Badli to surrender his passport pending the disposal of the case. She also fixed March 15 for the mention of the case.

Malaysian Anti-Corruption Commission deputy public prosecutor S. Thangavelu had proposed bail of RM2.5 million for all five charges.

However, Nor Badli’s lawyer Kitson Foong said the amount was too high and was akin to “punishing” the accused.

“An excessive bail amount defeats the grounds of bail. The accused is not a ‘flight risk’, he has six children and he is a director of numerous companies,” he said, adding that his client had cooperated throughout the investigations.
