Banns for Curators; Republic of Malta; To the Court Marshall. By a decree given by the Court of Magistrate­s (Malta) on the 11th January, 2024, following a request by Joseph Schembri et it was ordered that Deputy Curators be selected to represent the unknown owners of the direct dominium of the maisonette number 6, Mokum, Da let i - ipress, Attard, in the acts of the schedule of deposit number 69/2024 in the names Joseph Schembri et vs Deputy Curators and in other relative and subsequent acts. By means of a schedule of deposit filed in the Court of Magistrate­s (Malta) on the 9th January, 2024, in the names Joseph Schembri, pensioner, son of Joseph Schembri and Lorenza née Galea, born in Qormi and residing in Attard (ID 281844M) and his wife Catherine Schembri née Caruana, housewife, daughter of Joseph Caruana and Rita née Bonnici, born in ejtun and residing in Attard (ID 952648M) vs Deputy Curators to represent the unknown owners of the direct dominium of 6, Mokum, Da let i - ipress, Attard, the applicants Joseph and Catherine spouses Schembri (ID 281844M and ID 952648M respective­ly) respectful­ly submitted: That the applicants are the owners of the premises or rather maisonette on the ground floor (ground floor) marked with o cial number six (6) previously with uno cial number seven (7) with the name Mokum (previously unnamed) and forming part of a block of unnamed and unnumbered buildings previously marked with the letter D in Da let i -

ipress, Attard (previously a new unnamed road accessible from another unnamed road leading to Triq Annibale Preca, Lija), which maisonette is subject to an annual and perpetual groundrent and is not revisable of €11.65 per annum; That this groundrent was originally imposed by Benjamino Sultana by virtue of a contract of emphyteusi­s in the records of Notary Alexander Sciberras Trigona of the 25th January, 1967; That when they acquired the premises in question as subject to the payment of the annual and perpetual groundrent they were not given any informatio­n as to who is to be paid this groundrent or as to who are the owners of the direct dominium and although they tried to carry out research in order to establish this, this resulted in the negative; That thus the applicants have no informatio­n about Benjamino Sultana or who are the actual owners of the direct dominium; That the applicants are to pay the respondent­s the sum of €58.25 representi­ng the annual and perpetual groundrent due on the direct dominium of the property above indicated for the period between the year 2020 and the year 2024, both inclusive, and this for the last five (5) years according to law; Thus, the applicants in order to safeguard all their interests from any responsibi­lity are calling upon this Honourable Court and under its authority are depositing the sum of €16.16, which together with €42.09 costs and fees, amount to the sum of €58.25 so that it be freely released to the respondent­s a er leaving the due receipt according to law. Applicants: Mokum, Da let i - ipress, Attard. Notificati­on: Deputy curators. You are therefore ordered to post a copy of these banns in the entrance of the court and call upon whoever wishes to act as curator to appear within six (6) days in this registry and file a note with a declaratio­n that he is prepared to act as such.You are also ordered to inform everyone that if there is no such declaratio­n within the stipulated time, this court will proceed to the selection of curators of o ce. A er so acting, or if you should encounter any di culty in the execution of the said banns, you are to inform forthwith this Court.
