Prosecutor requests revocation of immunities of lawmakers involved in crimes

Lawmaker D.Gantulga has been accused of raping a 25-yearold female student at her home and another lawmaker D.Murat was accused of sending sexually explicit messages and photos to a woman last year.

On June 7, the General Prosecutor put forward a request to revoke the lawmakers’ immunities to investigat­e their cases to Parliament.

As Section 29.3 of the Constituti­on states, “An issue pertaining to a lawmaker who was involved in a crime shall be discussed and decided by a parliament­ary session on whether his or her powers and immunity should be suspended or not. If a court rules that the lawmaker is guilty of a crime, Parliament shall permanentl­y suspend the parliament­ary membership of the lawmaker.” As such, only Parliament has the right to revoke the immunities of D.Gantulga and D.Murat.

D.Gantulga is a newly elected lawmaker representi­ng the Mongolian People’s Party in Parliament and D.Murat is a member of the Democratic Party.

The two parties are scheduled to hold a caucus meeting on Friday to review the General Prosecutor’s request. Parliament is expected to review this issue after the caucus meetings.

Under the law, Parliament must respond to the General Prosecutor’s request within 48 hours, meaning that Parliament must to make a decision on this issue within June 9.
