Legal Standing Committee postpones review for Constitutional Court’s ruling on some laws
On Thursday, Parliament’s Legal Standing Committee reviewed the decision of the Constitutional Court on some sections of the General Administrative Law and the Law on Administrative Court’s Review Procedures which violated the Constitution.
Head of the standing committee Sh.Radnaased introduced the lawmakers in attendance to the Constitutional Court’s ruling, but lawmakers Ts.Munkh-Orgil and O.Baasankhuu asked to postpone the court order because they believe that lawmakers need to review it further.
As the majority of the standing committee’s members accepted the two lawmakers’ proposal, the committee will meet again on November 30 to review the matter.
Some lawyers submitted a request outlining that some parts of the two laws violate the Constitution to the Constitutional Court this summer, and the court ruled in their favor.
One of the lawyers said recently that Parliament amended the two laws, but the amendments to the laws violated several parts of the Constitution, for instance, a whole section of the amendments breaches Section 49.1 of the Constitution stating that a judge shall work independently and under the law.
