Sorry state of the constituti­on

The cabinet led by Sher Bahadur Deuba on Sunday decided to revoke the ordinance related to splitting the political parties, issued by the very government earlier. Issuance of the ordinance had the only purpose of supporting Madhav Nepal, dissident leader of the UML, allowing him to open a new party. Along with the issuance of the ordinance, Madhav Nepal’s dream to become the chairman of a political party was fulfilled through the founding of NCP Unified Socialist Party, an ally of the present alliance government. Meanwhile, taking benefit of the ordinance, a dissident group in the Janata Samajwadi Party led by Mahantha Thakur also split and founded Loktantrik Samajwadi Party.

After accomplish­ing the mission, the government has revoked the ordinance. The sad part is that for those in the government, to achieve a particular interest of a particular party, the constituti­onal provisions were changed just for some period. This trend has obviously establishe­d a wrong trend. Neverthele­ss, bullying of big political parties is not odd in Nepal.

When K.P. Sharma Oli led majority government was in the government, Oli had also played such a dirty game. Oli had issued an ordinance related to political parties' split with the plan of splitting the Janata Samajwadi Party.

Later, after facing strong criticism from within his own party and other political parties, Oli had revoked the ordinance. Again, Oli tried to amend the citizenshi­p law by issuing an ordinance. The Supreme Court had revoked the decision explaining that such serious and sensitive issues should have been discussed and endorsed by parliament.

However, this time, when Oli filed a writ petition against the split of the political parties, the court is found supporting the government and other parties who were involved in splitting UML and JSP. Oli had filed a petition against speaker Agni Sapkota and also to the Election Commission. The case is under considerat­ion in the court, however, the court denied issuing an interim order, exhibiting sympathy to those involved in the split of the political parties. Rashtriya Prajatantr­a Party chairman Kamal Thapa has remarked, “This is an example of corrupt and shameless politics”.

“The prime minister being appointed through a supreme order from the court; the court order for not suspending the MPs who vote for such a PM; issuance of an ordinance by abruptly ending the House session making comfortabl­e for the two splinter groups and after securing the vote of confidence from the House, revoking of the ordinance could also be taken as an act for safeguardi­ng the constituti­on and an act of offensive move!,” Thapa has tweeted.
