Threesome streamed live without consent

A Wellington man who filmed his threesome with a Finnish backpacker and a mate, and briefly livestream­ed it on Facebook, has been given supervisio­n.

Wellington District Court judge Tim Black yesterday ordered the man to complete nine months of supervisio­n in order to address his alcohol problem.

The man pleaded guilty to publishing an intimate visual recording in October 2016. His name was suppressed. The judge said the man and his friend had met the Finnish backpacker while drinking and swapped phone numbers.

Later in the night they met again and she invited them back to where she was living.

He said there was consensual sexual activity between all three before the man used his phone to film and livestream the other two.

The judge said that when it was noticed, the police summary noted there was a verbal altercatio­n.

‘‘I am sure that is an understate­ment,’’ the judge said.

The next day the backpacker – who had since returned to Finland – found the video was on her Facebook page.

The video post was later taken down.

The man told police he was drunk and playing a joke on his friend.

The judge said the man had a problem with alcohol and he was treating the case as a breach of privacy rather than a sexual offence, which would have seen the man go to prison.

The man’s lawyer Blake Dawson said there was nothing voyeuristi­c in the filming, all the sexual activity was consensual, but the broadcasti­ng was not.
