Queenstown District Court

-

A CROMWELL shearer was told by Judge John BrandtsGiesen to avoid alcohol when he was sentenced for assaulting a person he was in a family relationship with, and damaging her property in Queenstown in August.

Beau Grant Brabant (30) was ordered to complete 140 hours’ community work, sentenced to 12 months’ supervision and ordered to pay $1000 emotional harm reparation to the victim and $1167.30 reparation by Friday.

A protection order was also issued.

Judge BrandtsGiesen said early on August 5 Brabant was at his former partner’s address when she ended the relationship.

They had both been drinking. He became angry, pushed her from the couch on to the ground, causing her to hit her head on a coffee table, and then later pushed her on to a bed and held her down with both hands on her chest.

Brabant flipped the coffee table, breaking wine glasses and causing candle wax to spill on the carpet.

He took her keys outside and there was a struggle before she got them back, went back inside and tried to lock him out, but Brabant broke the lock trying to regain entry.

Judge BrandtsGiesen said alcohol seemed to be a recurring theme when Brabant’s prior convictions were considered.

He had convictions for drinkdriving in 2010 and 2016 and breaching the liquor ban in 2007, along with wilful damage convictions in 2007, 2008 and 2013 and a conviction for assault in 2013.

‘‘The best thing for you to do is not drink at all.’’

Caught drinkdriving again

Less than two weeks after being convicted for the second time for drinkdriving Jayden Robert Lyon (32), retailer, of Queenstown, was charged with the same offence again.

At the end of April Lyon was caught driving with a breath alcohol level of 877mcg in Queenstown and was subsequently disqualified from driving for 28 days, after which he was ordered to apply for an alcoholinterlock licence.

However, on May 14 Lyon was caught driving in Hallenstein St with a breath alcohol level of 678mcg.

He was also charged with driving while disqualified and breaching community work.

Defence counsel Liam Collins said Lyon acknowledged how close he was coming to a sentence of imprisonment.

Judge BrandtsGiesen said Lyon consumed half a bottle of wine before driving from Jacks Point to Queenstown.

He was observed by an offduty police officer overtaking a bus and swerving across the centre line in Frankton Rd.

On all three charges he was sentenced to 12 months’ supervision, with special conditions, and four months’ community detention with a nightly curfew from 8pm to 6.30am.

For driving while disqualified he was disqualified for six months and on the drinkdriving charge he was ordered to apply for an alcohol interlock following the disqualification period.

Dangerous driving

Steven Ryan Oliver (24), of Auckland, was ordered to pay $13,325 reparation in full after admitting a charge of dangerous driving, relating to an incident in Taupo on March 20.

Oliver was driving at 12.45am when he travelled on the wrong side of the road for about 50m after exiting a roundabout, drove up and over a grass verge, hit a parked vehicle and an electronic billboard, causing extensive damage to both.

He kept driving for another 30m but ended up going down a bank and landing in the southbound lane of another road.

His vehicle was also extensively damaged.

Oliver ran from the scene before police arrived.

He later told police he had not driven in seven years, was used to driving a manual vehicle, not an automatic, and had put his foot on the accelerator when he meant to hit the brake.

A reparation report found he owed $7000 to Omega Rentals and $6325 for damage caused to the electronic billboard.

Along with reparation, to be paid at $120 a week, he was disqualified for six months and ordered to complete a driving test.
