WHAT KYLEE GUY WANTED THE CORONER TO DO:

The full circumstan­ces of her husband’s death are not known because the identity of his killer has not been establishe­d through the courts.

Macdonald should be summoned to give evidence in person. To date, the only informatio­n about his whereabout­s at the time of the murder has come from police interviews.

It is in the interest of the public and other suspects that a definitive ruling be made on who killed Scott Guy, given the large amount of speculatio­n surroundin­g the killer’s identity.

Kylee and her two sons, Hunter and Drover, want to feel assured that all available steps have been taken to find Mr Guy’s killer. At present, Kylee feels this has not been done.

WHY THE CORONER REFUSED:

The circumstan­ces of Scott Guy’s death have been adequately establishe­d following a comprehens­ive police investigat­ion and subsequent High Court trial.

A ruling on the identity of the killer is not going to further the purpose of the coroner’s court, which is to prevent future deaths.

Macdonald exercised his right not to give evidence at his trial and the integrity of the process would be undermined if the coroner forced him to.

There are no known suspects whose reputation­s would be tarnished by leaving the identity of Mr Guy’s killer in the air.

While interestin­g to the public, the case does not have public issues in the context of death prevention – needed to resume a coronial inquiry.
