Court dismisses suit on NERC chairman

- From Nurudeen Oyewole, Lagos

A Federal High Court sitting in Lagos has thrown out the suit seeking the imprisonment of chairman of the Nigerian Electricity Regulatory Commission (NERC) Dr. Sam Amadi, who was accused of undermining the judiciary.

One Toluwani Adebiyi had sued Amadi, accusing him of supposedly accusing judges of frustrating the reforms in the power sector by granting “reckless and inconsiderate injunctions” against the regulatory agency.

Justice Mohammed Idris advised Adebiyi to withdraw the application, saying “the polity was already too heated at the moment”.

The judge however condemned Amadi for the petition he wrote against the court, describing it as reckless. He granted an application by electricity distribution companies seeking increment in electricity tariff.

It would be recalled that Amadi had allegedly petitioned the Chief Judge of the Federal High Court, Justice Ibrahim Auta, against Justice Idris, who restrained NERC from increasing electricity tariff in the country. The suit was later adjourned till November 24.
