Court orders re­in­state­ment of Sokoto Au­di­tor-Gen­eral

The Na­tional In­dus­trial Court in Sokoto has or­dered the im­me­di­ate re­in­state­ment of a for­mer Au­di­tor Gen­eral of Sokoto State Sambo Nawawi and the pay­ment of all his en­ti­tle­ments.

Nawawi had filed a suit chal­leng­ing his re­tire­ment by the Sokoto State govern­ment, which he de­scribed as pre­ma­ture since he did not reach the statu­tory 60 years re­tire­ment age as stip­u­lated by the con­sti­tu­tional pro­vi­sions for Au­di­tor Gen­eral.

Jus­tice Kiyashot Dam­lak said the con­sti­tu­tion made spe­cific terms of re­tire­ment for of­fice of the Au­di­tor Gen­eral with cor­rob­o­rat­ing law­ful pro­vi­sions. He said Sokoto State laws and sub­se­quent mod­i­fi­ca­tions were voided be­cause the con­sti­tu­tion su­per­seded them.

Coun­sel to Nawawi, Sufi Basheer, had said his client’s ap­point­ment was wrongly ter­mi­nated and prayed the court to re­in­state him.

But the Sokoto State At­tor­ney Gen­eral, Mr Suleiman Us­man, SAN, who rep­re­sented the state govern­ment, said laid down pro­ce­dures were ad­hered to as the law pro­vided that civil ser­vants should reach 60 years of age or 35 years in ser­vice.
