China, mapapasailalim sa batas ng ‘Pinas sa joint exploration

Kailangang tumalima ang China sa mga batas ng Pilipinas sakaling matuloy ang joint exploration sa Service Contract (SC) 57 dahil ang nasabing lugar ay nasa ilalim ng exclusive economic zone (EEZ) ng bansa, idiniin ng Malacañang.

Naglabas ng pahayag si Presidential Spokesperson Harry Roque ilang araw matapos niyang inanunsiyo na mayroong dalawang lugar na maaaring isailalim sa joint exploration ng Pilipinas at China -- ang SC 57 at SC 72.

Sa press briefing sa Palasyo kahapon, sinabi ni Roque na dahil ang SC 57 ay nasa ilalim ng EZ ng Pilipinas, kailangang sumunod ang China sa batas ng bansa.

“As far as 57 is concerned, they will comply with the decision with La Bugal [ruling]. They can participate in exploration and exploitation provided, as the decision says, we have ultimate control over the exploration and the development,” ani Roque.

Kinumpirma din ang opisyal ng Palasyo na ang China ay mapapasailalim sa kontrol ng Pilipinas para sa joint exploration sa SC 57.

“They’re only a foreign entity engaged in exploration and development. But they have to do it under Philippine laws,” ani Roque.

“They will absolutely be subject to Philippine laws if it is [SC] 57. It would have to be the mining code. The domestic law of the Philippines will prevail over [SC] 57,” idinugtong niya.

Ayon kay Roque, titiyakin ng gobyerno na masusunod ang local mining laws at ang buwis na kinita mula sa natural resources sa SC 57 ay babayaran sa Estado.

Ayon sa Philippine National Oil Company (PNOC), ang SC 57 ay iginawad sa PNOC Exploration Corporation (EC) noong Setyembre 15, 2005. Sinasakop nito ang total area na 7,120 sq. km. in offshore Northwest Palawan at matatagpuan may 50 kilometro sa hilagang kanluran mula sa dulong hilagang- kanluran ng Busuanga Island.

Ang SC 72 ay iginawad sa Sterling Energy Ltd noong Hunyo 2002. Ito ay matatagpuan sa West Philippine Sea, sa kanluran ng isla ng Palawan at timog kanluran ng Shell-operated Malampaya Gas Field. Sinasakop ng SC 72 ang 8,800 square km.

“As to [SC] 72, the agreement on joint exploration will be governed by international law because there has to be a treaty to be signed between the Philippines and China first on the joint exploration before it can be implemented by juridical entities of the contracting states,” ani Roque.
