Pag-aresto sa bar lawyers, ‘potential for abuse’
Ang pag-aresto sa tatlong abogado sa pagpapatupad ng search warrant sa Times Bar sa Makati City kamakailan ay nagsisiwalat sa posibleng pag-abuso ng mga pulis sa anti-illegal drug operations, ayon sa head ng law firm na kinabibilangan ng tatlo.
Sa isang kuwento na ibinahagi sa website ng European Journal International Law (www.ejiltalk.org), sinabi ni Diane Desierto, co-owner ng 16 na taong Desierto and Desierto family law firm, na ginawa lamang ng tatlong abogado -- Jan Vincent Soliven, 34; Lenie Rocel Rocha, 25; at Romulo Bernard Alarkon, 33; ang standard procedure sa kanilang propesyon.
Sinimulang magkuwento ni Desierto na pagsasabing ang tatlong abogado ay nagpakilala sa mga pulis bilang “legal counsels of a foreign national” na nagmamay-ari ng Times Bar.
Ang Times Bar, na matatagpuan sa Makati Avenue, sa Barangay Poblacion, ay sinalakay kung saan nasamsam ang P1.6 milyong halaga ng party drugs at marijuana noong Agosto 11.
Hindi binuksan ng raiding team, Station Drug Enforcement Unit (SDEU) ng Makati City Police, ang dalawang cabinet sa loob ng bar kaya ikinasa ang follow-up operation noong Agosto 16, upang alamin ang laman nito.
Kinasuhan si Burton Joseph Server, ang may-ari ng Times Bar, at 31 nitong tauhan dahil sa naging resulta ng pagsalakay.
“Our client asked the firm to send lawyers to monitor and watch the search of those two cabinets to safeguard against any planting of evidence or theft. Standard procedure,” ani Desierto.
Matapos ang paggalugad, sinabi ni Desierto na kinuwestiyon ng mga abogado kung bakit sila naroon sa lugar.
“My lawyers respectfully said they were legal counsels of the owner and were just sent by the firm to take notes and photograph the opening of the cabinets. But instead, one of the police team members thought they were being ‘arrogant’ and immediately arrested them on a charge of ‘obstruction of justice,’” sambit niya. OBSTRUCTION OF JUSTICE
Ayon kay National Capital Region Police Office (NCRPO) Director Guillermo Eleazar, kinasuhan ang tatlong abogado ng apat na offenses, kabilang ang obstruction of justice, dahil hindi nagpakilala bago pumasok sa bar, taliwas sa sinabi ni Desierto.
“During the conduct of the search, dumating ‘yung mga ‘yon and pumasok na lang nang hindi nagpapaalam. They were cautioned by the police there, tinanong kung sino sila but they refused to give information to the point na nakialam na sila. They interfered with the procedure in the implementation of the search warrant,” pahayag ni Eleazar.
Hindi pa sinasabi ng awtoridad kung positibo o negatibo sa ilegal na droga ang dalawang cabinet. ‘MOTU PROPRIO’ PROBE Sinimulan na ng Commission on Human Rights (CHR) ang “motu proprio” investigation kaugnay ng pag-aresto ng mga pulis sa tatlong abogado.
Ayon kay CHR spokesperson Jaqueline De Guia, nais lamang nilang mabatid kung may pag-abuso sa panig ng awtoridad o kung ang mga abogado ang nagkaroon ng maling hakbang.
