Proclamation No. 572 paiimbestigahan sa Senado

Naghain ang Senate minority bloc ng resolusyon na humihiling sa liderato ng Senado na silipin ang validity ng pag-isyu ni Pangulong Rodrigo Duterte ng Proclamation No. 572 na nagpapawalang-bisa sa amnestiya na ipinagkaloob kay Senador Antonio Trillanes IV ng nakalipas na administrasyong Aquino.

Hinimok ng minority senators, sa pamumuno ni Sen. Franklin Drilon, ang akmang Senate committees na magsagawa ng imbestigasyon dito “for the purpose of looking into possible remedial legislation to prevent and/ or avert possible abuse of Presidential powers in the future.”

Lumagda sa resolusyon sina Drilon, Leila de Lima, Paolo “Bam” Aquino IV, Francis “Kiko” Pangilinan, at Risa Hontiveros.

“Due to the issuance of the said proclamation, Senator Trillanes is deprived of his liberty and is under constant threat of being arrested whe in truth, and in fact, there is no basis for an arrest, as there is no arrest warrant and there are no cases filed against him justifying his arrest,” punto nila sa Senate Resolution No. 887.

DESPERADO

Samantala, lalong nagiging desperado ang mga abogado ni Pangulong Duterte na maghanap ng “legal justification” sa kanyang deklarasyon na ipawalang-bisa ang amnestiya ni Trillanes, ayon sa isang law expert.

Sinabi ni dating Solicitor General Florin Hilbay na halata ang pagiging desperado ng mga ito sa magkakaibang paliwanag ng gobyerno para bigyang katuwiran ang deklarasyon ni Duterte.

“It’s clear that the military and the police establishments don’t want anything to do with the proclamation. Now, it’s up to the lawyers for the President to scrounge for some legal justification to save this particular proclamation,” aniya sa ABS-CBN News Channel kahapon.

Kinontra rin ni Hilbay, professor ng constitutional law sa University of the Philippines, ang pahayag ni Chief Presidential Legal Counsel Salvador Panelo na ang pagpapawalang-bisa sa amnestiya ni Trillanes ay inherent right ni Duterte para protektahan ang estado mula sa pag-atake ng mga personalidad na tulad ni Trillanes.

Iginiit ni Hilbay na hindi conditional ang amnestiya. “That is even more outrageous than the usurpation argument they are trying to use,” aniya.

Dahil sa proklamasyon ni Duterte, sinabi ni Hilbay na inilagay nito sa alanganin ang integridad ng buong amnesty system, at maging ang peace process.
