Tax amnesty na aalis sa bank secrecy, hirit ni Duterte

Nanawagan si Pangulong Rodrigo Duterte sa Kongreso na ipasa ang isa pang tax amnesty measure na may maayos na proteksiyon na kinabibilangan ng pag-alis sa bank secrecy para sa fraud cases.

Ito ang apela ng Pangulo matapos niyang i-veto ang pagkakaloob ng general amnesty at dalawa pang naunang probisyon sa bagong Republic Act No. 11213 o ang Tax Amnesty Act.

Sa kanyang veto message sa Kongreso, nagbabala si Duterte na ang “overgenerous and unregulated” general amnesty program ay maaaring prone sa pang-aabuso at lilikha ng mainam na kapaligiran para sa tax evasion o pagtakas sa buwis.

“The general amnesty program is meant to give taxpayers a fresh start as well as to signal the start of a fair tax enforcement campaign by the tax authorities. It is not meant to be abused for the gain of the few and the loss of the rest of the citizenry,” aniya.

“Given these, I ask Congress to pass another general tax amnesty bill that includes the lifting of bank secrecy for fraud cases, the inclusion of automatic exchange of information and safeguards to ensure that asset or net worth declarations are truthful,” dugtong niya.

Kamakailan ay nilagdaan ng Pangulo ang Republic Act No. 11213 ang Tax Amnesty Act ngunit inayawan ang tatlong probisyon na maaaring maging bukas sa pang-aabuso. Samantala, pinanatili niya ang estate tax amnesty program at ang amnesty on delinquency taxes, sa bagong batas.

Hindi sumang-ayon si Duterte sa general amnesty provision ng batas dahil sa kakulangan ng mga probisyon “[on] breaking down the walls of bank secrecy,” at iba pa.

Ibinasura din niya ang probisyon na magpapahintulot sa one-time declaration at settlement ng estate taxes on properties subject of multiple unsettled estate.

Isa pang probisyon na ibinasura ng Pangulo ay ang presumption of correction of the estate tax amnesty returns.
