Panelo: Veto ni Duterte puwedeng baligtarin ng Kongreso

Maaaring baligtarin ng Kongreso ang anumang veto ni Pangulong Rodrigo Duterte kung ang nasabing opsiyon ay ilalapat upang harangan ang isang panukalang batas na magre-renew sa prangkisa ngABSCBN network, ayon sa isang opisyal ng Palasyo.

Kinilala ni Presidential Spokesman Salvador Panelo na ang Kongreso ay may awtoridad na magbigay o magrenew ng lehislatibong prangkisa sa broadcast network sa kabila ng “displeasure” ng Pangulo sa kompanya.

“Let me say that the grant of a franchise falls exclusively within Congress,” sinabi ni Panelo sa mga mamamahayag sa Palasyo nitong Martes.

“Even in the—because some people are saying, ‘Oh but the President can veto,’ in the event that the renewal is given by the Congress and the President vetoes it. Again, the Constitution says that can be by a twothirds vote,” aniya.

Ginawa ni Panelo ang mga komentaryo matapos ihain ng Office of Solicitor General sa Korte Suprema ang quo warranto petition na naglalayong mapawalang-bisa ang prangkisa ng network. Nangatwiran ang abogado ng gobyerno na ang network ay lumabag sa ilang mga batas, kasama na ang pagbabawal sa konstitusyon sa pagmamay-ari ng dayuhan.

Itinanggi ng network na pagmamay-ari ng mga Lopez ang mga paratang ng Solicitor General, iginiit na hindi ito lumabag sa batas.

Muling iginiit ni Panelo na si Pangulong Duterte ay walang kinalaman sa legal action na isinagawa ni Solicitor General Jose Calida.

“The filing of a petition for quo warranto is on the initiative of the Solicitor General pursuant to his constitutional duty to file any action in court in the event of any, from his point of view, transgression of any law,” aniya.

Ipinaliwanag din niya ang mga pintas ng Pangulo sa TV network ay bahagi ng kalayaan sa pagpapahayag.

“Whatever utterances the President made in relation to ABSCBN came from his displeasure of being a victim of fraud relative to his paying for his campaign commercial that never was aired,” aniya.

“Now, those utterances fall within the freedom of expression, and we cannot deprive him of that given that the Constitution grants that to all citizens of the country. We will leave it to the Supreme Court vis-à-vis that petition,” sabi pa niya.
