De Lima acquittal likely — Remulla
Justice Secretary Jesus Crispin Remulla yesterday said the acquittal of former senator Leila de Lima in her last illegal drugs case is likely.
Recently granted bail, De Lima, according to Remulla, is likely to get acquitted as per the decisive statement from the presiding judge, who cited the prosecution’s failure to meet the burden of proof for her continued detention.
“Chances are she will be likely acquitted because that was as a strong statement (from the judge) when you say the prosecution was unable to fulfill the burden of proof to keep her in jail,” Remulla said.
Remulla reiterated that the Muntinlupa regional trial court’s decision permitting De Lima to post bail for illegal drug charges shows the independence of the judiciary, thus affirming the vitality of the country’s democracy.
“It demonstrates the judiciary’s autonomy, as I’ve consistently said affirming their freedom to decide as they see fit. This underscores that democracy is thriving in our nation,” Remulla said.
On the possibility of an appeal from the prosecution, Remulla said, “It’s the prosecution’s decision.”
“I refer to it as prosecutorial independence. I refrain from intervening in prosecutorial matters, particularly in these cases. We adhere to the principle of institutional continuity since assuming office. We honor the conclusions of previous prosecutors,” he added.
De Lima was very thankful for her temporary liberty and said she will complete her vindication and rebuild her life by getting full acquittal of the last drug case pending in Muntinlupa RTC.
