De Lima acquittal likely — Remulla

Justice Secretary Jesus Crispin Remulla yesterday said the acquittal of former senator Leila de Lima in her last illegal drugs case is likely.

Recently granted bail, De Lima, according to Remulla, is likely to get acquitted as per the decisive statement from the presiding judge, who cited the prosecutio­n’s failure to meet the burden of proof for her continued detention.

“Chances are she will be likely acquitted because that was as a strong statement (from the judge) when you say the prosecutio­n was unable to fulfill the burden of proof to keep her in jail,” Remulla said.

Remulla reiterated that the Muntinlupa regional trial court’s decision permitting De Lima to post bail for illegal drug charges shows the independen­ce of the judiciary, thus affirming the vitality of the country’s democracy.

“It demonstrat­es the judiciary’s autonomy, as I’ve consistent­ly said affirming their freedom to decide as they see fit. This underscore­s that democracy is thriving in our nation,” Remulla said.

On the possibilit­y of an appeal from the prosecutio­n, Remulla said, “It’s the prosecutio­n’s decision.”

“I refer to it as prosecutor­ial independen­ce. I refrain from intervenin­g in prosecutor­ial matters, particular­ly in these cases. We adhere to the principle of institutio­nal continuity since assuming office. We honor the conclusion­s of previous prosecutor­s,” he added.

De Lima was very thankful for her temporary liberty and said she will complete her vindicatio­n and rebuild her life by getting full acquittal of the last drug case pending in Muntinlupa RTC.
