DOLE pay rules for 2024 holidays out

The Department of Labor and Employment (DOLE) has issued an advisory specifying the wage computatio­ns for regular holidays and special non-working holidays for 2024.

DOLE Secretary Bienvenido Laguesma said it reminds all private sector employers to ensure the proper payment of wages in accordance with the guidelines in Labor Advisory No. 27, Series of 2023.

He said employees who would report to work during regular holidays should be paid a total of 200 percent of their wages for the first eight hours.

For employees’ overtime work, they should be paid an additional 30 percent of their hourly rate on the said day on top of the 200 percent.

Employees who report to work on a regular holiday that also falls on the rest day should be paid an additional 30 percent on top of the 200 percent wage. An additional 30 percent of the hourly rate shall also be paid when working overtime.

Meanwhile, employees who will not work should still be paid 100 percent of their wage for that day, subject to certain requiremen­ts under the implementi­ng rules and regulation­s of the Labor Code, as amended.

For special non-working days, the “no work, no pay” principle shall be observed, unless there exists a favorable company policy, practice, or Collective Bargaining Agreement (CBA) allowing payment on a special day.

For employees who will work, they are entitled to an additional 30 percent of the basic wage for the initial eight hours of work. Overtime work on these days warrants an extra 30 percent of the hourly rate.

If employees work on a special day that coincides with their rest day, they are entitled to an extra 50 percent of their basic wage for the first eight hours worked, with an additional 30 percent of their hourly rate for overtime work.

The regular holidays next year are New Year’s Day (January 1), Maundy Thursday (March 28), Good Friday (March 29), Araw ng Kagitingan (April 9), Labor Day (May 1), Independen­ce Day (June 12), National Heroes’ Day (August 26), Bonifacio Day (November 30), Christmas Day (December 25), Rizal Day (December 30), Eid’l Fitr (to be proclaimed), and Eid’l aladha (to be proclaimed).

Special (non-working) days are Chinese New Year (February 10), Black Saturday (March 30), Ninoy Aquino Day (August 21), All Saints’ Day (November 1), All Souls’ Day (November 2), Feast of the Immaculate Conception of Mary (December 8), Christmas Eve (December 24), and Last Day of the Year (December 31).
