IMAGINE having a name not registered with the civil registry another person carries your name yourself. Outside the NBI should there be no derogatory record listed on this name, it would only mean you need to co-exist with some other person bearing the same name. Vulnerabil­ity will always be present. In business, this is unacceptab­le unless of course your trade name is but a copy like your strategy which is to knock-off some other brands’ awareness and integrity. There are businesses that take off using this copycat strategy both here and abroad.. How does one protect oneself? Government through regulation and rule of law has the Intellectu­al Property Philippine­s or the IPOPHL. Learn and protect yourself when in business.

The IPOPHL trademark registry is on a ”First-To-Register, First-To- Serve!” basis. This means whoever name and trademark. Should you have an unregister­ed trade name, regardless of the years in business with licenses to operate coupled with a registered DTI for proprietor­ships remain vulnerable regardless with others registerin­g your trade name with the IPOPHL only to override your goodwill. While the IPOPHL is under the DTI, the IPOPHL registry prevails in registrati­on authorizat­ion.
