Sandigan affirms Bataan mayor’s suspension

The Sandiganbayan Sixth Division has affirmed the 90-day preventive suspension of Limay, Bataan Mayor Nelson David, in connection with his graft case. David’s case stemmed from his alleged involvement in the municipality’s overpriced purchase of agricultural land owned by his two sons, Richie Jayson and Christian Ryan David. Both of David’s sons were also part of the Municipal Appraisal Committee. The antigraft court earlier ordered that David be suspended, but he filed a motion for reconsideration on Aug. 20, arguing that the suspension order was “whimsical, capricious and unnecessary.” In its Oct. 1 resolution, the Sandiganbayan denied the motion for reconsideration for lack of merit. “The grounds relied upon by accused David are a mere rehash or reiteration of the grounds and arguments raised earlier and already passed upon and resolved by the Court in its resolution,” it said.
