City Council approved Ordinance 1817, which amended Section 5 of Ordinance 1661 and reset the plebiscite from May 6, 2000 to May 2002

Rep. Antonio Cuenco filed House Bill 5234 after the council failed to set the plebiscite for Ordinance 1661

Then president Arroyo signed Rep. Act 9905 into law creating Barangay Banawa-Englis

Plebiscite was set, but moved to March 13, 2010 after Comelec reported that funds for exercise were depleted
March 10, 2010
Then RTC judge Gabriel Ingles stopped the poll body from holding a plebiscite after then councilor, now barangay captain Vicente Buendia of Labangon, filed a petition that he would lose post if his residence would be included in the boundary set by the law

Ingles dismissed Buendia’s petition after he and his lawyer failed to attend hearing; petitioners then filed a motion for reconsideration

Ingles ruled with finality dismissing Buendia’s petition
