Why Julian Daan is not acting vice governor

Cebu Provincial Board Member Julian Daan a.k.a. Teban Escudero in the entertainm­ent business became No. 1 PB member when then board member Agnes Magpale, who topped the PB slate in the 2010 elections, moved up to the seat of vice governor when VG Greg Sanchez died on April 29, 2011.

After Magpale was installed last Dec. 14 as acting governor, the same day Gov. Gwen Garcia was suspended, Daan was prodded to assume as vice governor.

Daan hesitated, saying he’d wait for the petition for TRO to be decided. At one time, he was on the verge of accepting the VG post. Finally though, he declined, which people saw as an act of loyalty to One Cebu Party.

It was also a prudent move, says a Bzzzzz source (a veteran practicing lawyer).

The VG post is not vacated by Magpale’s assumption as acting governor, which is a temporary stint, for six months or earlier if a TRO is issued.

The source says that Magpale may return to her VG post when ordered by the court. She hasn’t lost the said post, just as Gwen has not lost hers, because suspension is not removal.

Magpale is both vice governor and acting governor, the source says. But while she’s doing the job of chief executive, she doesn’t preside over PB sessions and may entrust to Daan such other duties of a vice governor as she may delegate.

But why can’t Daan be acting vice governor (as he said, in an interview, it was how he’d like to be called) -- just as Magpale is acting governor but will revert to being VG if there’s a court order stopping or annulling Gwen’s suspension?

The Bzzzzz source didn’t explain that.
