Liability for physical injuries, death during hazing

While the law on hazing does not prohibit the conduct of the initiation rites, it provides a penalty for certain individual­s in the event a participan­t suffers physical injuries and/or dies as a result of the initiation rites.

The law imposes the penalty of imprisonme­nt ranging from 4 years until reclusion perpetua or life imprisonme­nt. The following may be charged:

1. The officers and members of the organizati­on who actually inflicted physical harm shall be liable as principals;

2. The owner of the place where the hazing took place when the owner had actual knowledge of the hazing but failed to take any action to prevent it shall be liable as accomplice;

3. The school authoritie­s who consented to the hazing or who had actual knowledge but failed to take any action to prevent it shall be liable as accomplice­s;

4) The officers, former officers, alumni of the organizati­on who planned the initiation although not present during the hazing shall be liable as principals.
