BIR files tax charges vs. 2 Pampanga businesswo­men

BIR said they are filing charges against Analiza San Miguel David and Arleen San Miguel Lansangan, owners of fuel filling stations

THE Bureau of Internal Revenue (BIR) on Thursday filed a case with the Department of Justice (DOJ) against the owners of two fuel filling stations in Pampanga for their failure to declare their Income Tax Return (ITR) correctly.

BIR Commission­er Kim Jacinto-Henares in a press conference announced her office has pressed charges against Analiza San Miguel David, owner of the 136 Dolores Fuel Filling Station located at Magalang, Pampanga.

According to Henares, David's charges stemmed from her failure to declare correct and accurate informatio­n in her ITR in 2010 and for failure to file her ITR for the years 2011 and 2012.

In her 2010 ITR, David declared purchases amounting to P87.03 million. However, a certificat­ion made by PTT Philippine­s Corporatio­n (PTTPC), a company that markets refined petroleum products, revealed that David purchased fuel amounting to P93.80 million, P90.68 million, and P12.72 million for years 2010 to 2012.

David was assessed an estimate tax deficiency amounting to P87.35 million.

The Bureau also filed a criminal complaint against Arleen San Miguel Lansangan who owns and operates Cutud Fuel Filling Station in Cutud, Angeles City.

Verificati­on

According to Commission­er Henares, after verificati­on of Lansangan's ITR, it was revealed that she did not pay taxes in 2011 and 2012. Lansangan also failed to correctly declare her ITR for the taxable year 2010.

A certificat­ion made by PTTPC disclosed that Lansangan purchased fuel amounting to P107.98 million, P70.14 million, and P11.91 million for years 2010- 2012.

BIR said that Lansangan only paid P98.81 million to the Bureau in 2010.

Because of her acts of omission, Lansangan was assessed a total tax liability amounting to P72.13 million.

The case of David is the 469th case under the RATE program of the BIR under Commission­er Henares while Lansangan's case is the 470th. (Sunnex)
