The Cebu City Police Office (CCPO) filed yesterday a complaint against car racer and Cebu-based businessman David Lim Sr., after the road crash that killed Philip Pogoy last Saturday.

A case for reckless imprudence resulting in homicide and damage to property was filed by the Traffic Patrol Group before the City Prosecutor’s Office.

The police will also monitor the whereabouts of the car racer.

Mayor Tomas Osmeña, in a Facebook post, thanked CCPO Director Joel Doria for “doing what is right.”

After learning about the accident, the mayor said he called Doria and told him not to give any special favor to the businessman.

“Settling an accident with the other party is private business, but running away from the scene makes it another thing entirely. That will have to be answered in the court of law,” he said.

In a separate Facebook post, David Lim Jr. defended his father.

“Well-off or less fortunate, car or motorcycle, an accident is an accident. Nobody ever intended for such misfortune or would ever want such a thing to happen,” he said.

The Traffic Patrol Group, in their initial report, said that Lim, who was driving at high speed, encroached on Pogoy’s lane.

The sports car collided headon with Pogoy’s motorcycle.

Following the accident, the lawyers of Lim and the family of Pogoy are negotiating for a possible settlement.

Doria said they will wait for its result.

Atty. Pedro Salva, who represents Lim, said that the negotiation is still ongoing.

“We’re hoping for a win-win solution,” he said in a text message to SunStar Cebu. /
