Pre-trial of Baktin men moved

THE court proceeding­s for the four self-confessed members of Ryan “Baktin” Yu carnapping syndicate have been re-scheduled for next month.

Charged earlier with violation of the Republic Act 6539 or The Anti-Carnapping Act of 1972 were Gerry Paulino, 30, of Buhangin in Davao City; Eddie Lopez, 19, of Marilog District, this city; Diego Macatimban­g, 19, of Davao Oriental; and Hermie Tahom, 36, of Surigao del Sur,

Judge Evalyn M. Arellano-Morales, of the Regional Trial Court (RTC) Branch 17 re-scheduled the pre-trial conference on June 21 instead May 10, 2013, considerin­g the reason of Lawyer Luwill Tiu Al-ag.

Court order penned by Arellano-Morales, dated May 10, shows that Lawyer Luwil Al-ag, legal counsel for

Paulino, requested for the re-scheduled of the pre-trial conference; as he is not ready to proceed on the matter.

Lawyer Hazel Ariola also appeared in the collaborat­ion with Lawyer Heraclio Malaki III, for Lopez, Macatimban­g, and Tahom on May 10. Since Lawyer Aimee Torrefranc­a, a legal counsel of the complainan­t--Sumifro did not object on the request thus, the suspension of pre-trial.

In a recent subpoena, penned by Lilian May C. Alpas, officer in charge of the RTC Branch 17, the four accused were ordered to appear the court on the date scheduled. She added that failure to follow the order without adequate cause will face their consequenc­es.

The accused are expected to appear anew before the court with their legal counsels--Atty. Luwill Tiu Al-ag for Paulino and Atty. Hazel Ariola for the three other accused.

The two counsels for the accused assured that their clients would be available on the court proceeding­s especially that they pleaded not guilty on their arraignmen­t on November 21, 2012 on the carnapping charges earlier filed against them.

Paulino is the only one among the four accused who did not post bail as he opted to remain under the custody of the Davao City Police Office for security purposes, while the others were released from jail last November 7, after they posted P180,000 bail each. ICT
