Trial of lesbian in parricide postponed
THE TRIAL of a lesbian, who was earlier accused of killing her grandparents and a cousin, has been moved next month.
Marivic Sisiban Liloc, 22, of Panacan in Davao City, was charged with two counts of parricide for killing her grandparents Fedil Liloc, 75; and Teodora Liloc, 74; murder for the death of her cousin Christian Mark Campano, 2; and two counts of frustrated murder in stabbing her 11-year-old, and one-month-old cousins.
Judge Evalyn M. Arellano-Morales, of the Regional Trial Court (RTC) Branch 17, for the seventh time, rescheduled the arraignment of the accused on June 28 at 8:30 a.m. after a warrant officer, failed to serve the subpoena to the attending physician of the accused.
Court order penned by Arellano-Morales, dated May 17, showed that the arraignment on the determination whether the accused is fit to stand trial was moved after a return of warrant officer, stating that the subpoena to Dr. Evangeline Castro of the Department of Psychiatry of Southern Philippines Medical Center (SPMC), was not served due to lack of material time.
Liloc was earlier subjected to undergo a neuropsychiatric evaluation at the SPMC, after Jail Inspector Jerry Grace G. Danao, OIC wardress of Davao City Jail informed the court that Liloc “was observed to appear
unkempt and was unable to give responses to queries.”
“Likewise, she urinated in her lower garment and appeared restless and agitated. Moreover, during her detention, she was seen playing and putting feces in her mouth and is continually exhibiting aggressive behavior,” Danao said in a letter addressed to ArellanoMorales.
Arellano-Morales granted the request of the Davao City Jail in Maa officer so to determine whether the accused is fit to stand trial on October 25, 2012. But Psychological Evaluation Report submitted on March by Castro about the accused doesn’t state clearly as to whether she is fit to stand trial
“Considering the report doesn’t state clearly as to whether the accused is fit to stand trial, Public Prosecutor Carlos Castaños Jr. moved that the arraignment of the accused be reset,” ArellanoMorales said in a court order dated March 13, 2013.
Arellano-Morales added that a subpoena must be sent to the psychologist to attend the said arraignment and bring the necessary documents related to the case, which was not objected by the legal counsel of the accused, Lawyer Rudy Alonzo.
Liloc was earlier scheduled to appear before the court April 19, but Castro has already filed the leave of absence from March 11 to April 29 thus, the rescheduled of the arraignment on May 17, 2013.
“But a record shows that a return was submitted by a warrant officer, saying that he weren’t able to deliver the subpoena to the attending physician of the accused thus, she wasn’t able to attend the schedule arraignment. In view on the matter, the arraignment is reset to June 28 from May 17 at 8:30 a.m.” Arellano-Morales said in a recent court order.
The accused was arrested on September 27, 2012 after she committed the crime against her grandparents and cousins. No bail is recommended for the two counts of parricide case, which were raffled off to RTC Branch 17.
Liloc was transferred from Sasa Police Station to Davao City Jail in Maa on October 5, 2012 where until now she is detained. The accused is expected to appear anew before the sala of Arellano-Morales, of RTC Branch 17 to answer the charges filed against her. ICT
