2 accused drug pushers charged

-

TWO accused drug pushers are facing charges before the court after their arrest last January 13, Friday, in a drug bust operation conducted by personnel of the Davao City Police Office (DCPO) in Tugbok District in Davao City.

Charged for violating sections 5 and 11 of the Republic Act (RA) 9165 or The Comprehensive Dangerous Act of 2002 are Cris Gandong Apura, alias Cocoy; and Ritche Alferez Furmentera, both residents from Tugbok.

Prosecutor Jose Paolo Evangelista, associate prosecution attorney II, found probable cause to charge the two accused based on the affidavit of complaint filed by DCPO personnel PO2 Ansan K. Malik and PO3 Robert A. Abarquez.

In a resolution dated January 24 this year, the complaint was resolved pursuant to Rule 112 of Revised Penal Code after the two accused referred to Public Attorney’s Office (PAO) opted not to avail the preliminary investigation.

As reported, the two accused were arrested in a drug bust operation at Purok 21 in Barangay Mintal in Tugbok, after a confidential informant

reported to the police that one “Cocoy” has been selling illegal drugs at San Francisco Street.

Police arrested the accused after Apura handed a plastic sachet of suspected methamphetamine hydrochloride, also known as shabu, to a police officer who acted as a buyer. The police then signaled other members and arrested the accused.

Aside from the sachet sold to the poseur buyer, the police also recovered other two sachets of suspected shabu from the accused. One sachet is weighed at 0.0273 grams (g), while the two others weighed at 0.0258g and 0.0531g.

Based on the Chemistry Report from Regional Crime Laboratory Office (RCLO), Evangelista said all sachets containing white crystalline were found positive for shabu. Furmentera was also found positive for drugs based on urine sample.

The prosecution office resolved that the accused were lawfully arrested pursuant to Rules of Court; that the sachets of suspected shabu were recovered from the accused; and that the accused will be criminally charged, respectively. ICT(For full story visit www.sunstar.com.ph/davao/)
