2 men sued for theft
TWO men are facing charges before the court after they broke into a private car and took an expensive bag that contained several valuable items and cash along Cabaguio Avenue in Agdao District, Davao City last week.
Charged with theft are Jerry Samiana Orcullo, Jr. and Wilson Composagrado Peraan, all residents of Barangay Leon Garcia in Agdao District.

In a two-page resolution dated October 26, the incident took place around 3:15 p.m. on October 19, Thursday, while the complainant had her car fixed on a car shop at Cabaguio Avenue.
Coming from the cashier of the establishment, the complainant was on her way to her car when she noticed the two accused, of whom one of them opened the driver’s side door, took her Furla bag and passed it to the other accused.
The complainant alerted the people around by shouting for help. She then reported that incident to Sta. Ana Police Station where she was led to the rouge gallery and identified Orcullo as among the two suspects who took her bag.
Police arrested Orcullo in a house in Barpa, Barangay Leon Garcia after the complainant positively identified him.
Recovered from Orcullo was the Furla bag worth 45,000, containing one iPhone 6S Plus worth P55,000; one iPhone 7 worth P60,000; one sun glasses worth P20,000; a pocket wifi worth P5,000; and make-up kit worth P7,000.
The policemen also recovered the identification cards of the complainant while the P60,000 cash from the wallet of the latter was already gone.
Nothing was mentioned as to why the police operatives did not pursue Peraan. Despite the fact that some of the complainant’s valuables were recovered, the furtive taking was already completed and the offense consummated.
The prosecution said the accused should be charged for whole value of the items taken including the cash which was not returned to the complainant. Thus, bringing the amount involved to P252,000.
Since Peraan was not yet arrested, the complaint against him is not proper for inquest proceedings. The prosecution was then directed for preliminary investigation against him. ICT
