Kris' lawyers warn broad­cast sta­tions?

Nicko Fal­cis, for­mer fi­nance man­ager of Potato Cor­ner + Na­cho Bimby and for­mer en­dorser closer, tal­ent agent, and project di­rec­tor of Kris Aquino’s dig­i­tal com­pany, Kris Aquino Co­juangco Pro­duc­tions (KCAP), protested the lat­ter’s ac­tion of send­ing let­ters to broad­cast sta­tions re­gard­ing the air­ing of Fal­cis’ side.

It can be re­called that Div­ina Law, one of the law firms that han­dle the le­gal con­cerns of the ac­tress, wrote a let­ter to TV5 on Jan­uary 8, 2019.

The law firm re­minded the sta­tion re­gard­ing the air­ing of the side of brothers Nicko and Atty. Jess Fal­cis as their only pur­pose is to ma­lign their client, Kris.

Part of the let­ter stated: “We un­der­stand that Mr. Ni­cardo M. Fal­cis II (Nicko) and his brother Atty. Je­sus Ni­cardo M. Fal­cis III ( Jess) are ap­proach­ing var­i­ous tele­vi­sion and ra­dio sta­tions try­ing to ar­range for in­ter­views and/or guest ap­pear­ances on shows with a clear in­tent of ma­lign­ing, hu­mil­i­at­ing and de­stroy­ing the rep­u­ta­tion of our client through defam­a­tory state­ments, ma­li­cious in­nu­en­dos and un­founded ac­cu­sa­tions.

“While we rec­og­nize your con­sti­tu­tional right to free speech, free ex­pres­sion and press free­dom, we reit­er­ate that Li­bel is not pro­tected speech.

“Thus, we cau­tion you from air­ing or broad­cast­ing these in­ter­views with­out ver­i­fy­ing the al­le­ga­tions or se­cur­ing the side/ex­pla­na­tion of our client.

“Ev­ery defam­a­tory im­pu­ta­tion is pre­sumed ma­li­cious (Ar­ti­cle 354, Re­vised Pe­nal Code).

“Li­a­bil­ity for defam­a­tory state­ments pub­lished by ra­dio or tele­vi­sion may be had from the owner of the sta­tion, a li­censee, the op­er­a­tor of the sta­tion, or a per­son who pro­cures, or par­tic­i­pates in, the mak­ing or caused the broad­cast or pub­li­ca­tion of the defam­a­tory state­ments.”

Mean­while, in his In­sta­gram Sto­ries on Jan­uary 11, Nicko said they are not afraid of Kris and they won’t bend their knees to her.

He said (pub­lished as is): “Your army of lawyers tried to es­tab­lish me­dia blackout by send­ing ‘strongly worded’ memos to them and even tasked your paid en­tourage to fish for in­for­ma­tion from all EXKCAP em­ploy­ees.

“Stop bul­ly­ing the me­dia. Stop bul­ly­ing our fam­ily! You are not the queen and we will NOT bend the knee!” /
