Kris' lawyers warn broadcast stations?

Nicko Falcis, former finance manager of Potato Corner + Nacho Bimby and former endorser closer, talent agent, and project director of Kris Aquino’s digital company, Kris Aquino Cojuangco Production­s (KCAP), protested the latter’s action of sending letters to broadcast stations regarding the airing of Falcis’ side.

It can be recalled that Divina Law, one of the law firms that handle the legal concerns of the actress, wrote a letter to TV5 on January 8, 2019.

The law firm reminded the station regarding the airing of the side of brothers Nicko and Atty. Jess Falcis as their only purpose is to malign their client, Kris.

Part of the letter stated: “We understand that Mr. Nicardo M. Falcis II (Nicko) and his brother Atty. Jesus Nicardo M. Falcis III ( Jess) are approachin­g various television and radio stations trying to arrange for interviews and/or guest appearance­s on shows with a clear intent of maligning, humiliatin­g and destroying the reputation of our client through defamatory statements, malicious innuendos and unfounded accusation­s.

“While we recognize your constituti­onal right to free speech, free expression and press freedom, we reiterate that Libel is not protected speech.

“Thus, we caution you from airing or broadcasti­ng these interviews without verifying the allegation­s or securing the side/explanatio­n of our client.

“Every defamatory imputation is presumed malicious (Article 354, Revised Penal Code).

“Liability for defamatory statements published by radio or television may be had from the owner of the station, a licensee, the operator of the station, or a person who procures, or participat­es in, the making or caused the broadcast or publicatio­n of the defamatory statements.”

Meanwhile, in his Instagram Stories on January 11, Nicko said they are not afraid of Kris and they won’t bend their knees to her.

He said (published as is): “Your army of lawyers tried to establish media blackout by sending ‘strongly worded’ memos to them and even tasked your paid entourage to fish for informatio­n from all EXKCAP employees.

“Stop bullying the media. Stop bullying our family! You are not the queen and we will NOT bend the knee!” /
