NCIP, CDC : CORRECT THE FLAGRANT INJUSTICE

RE: THE 10,323.3082 HECTARES ANCESTRAL DOMAIN UNDER CADT NO. R03-BAM-1402-025-A LOCATED AT BAMBAN, TARLAC AND MABALACAT, PAMPANGA

SIR:

This refers to the above subject Ancestral Domain that is covered by a JOINT-MANAGEMENT AGREEMENT (JMA), executed on December 6,2007 by CLARK DEVELOPMENT CORPORATION (CDC), NATIONAL COMMISSION ON INDIGENOUS PEOPLES (NCIP) and TRIBONG AETA of CADT NO. R03BAM-1402-025-A, represented by Chairman/ President OSCAR B. RIVERA of the BAMBAN AETA TRIBAL ASSOCIATION.

The NCIP, as mandated by R.A. 8371, shall be the primary Government Agency plans and programs to RECOGNIZE, PROTECT and PROMOTE the rights of ICCs/ IPs

responsible for the formulation and implementation of policies,

Unfortunately, this is not happening, as expressed in the news items in Sun Star Pampanga and other supporting material documents relative to the above-stated 10,323.3082 hectares Ancestral Domain -- all addressed to the Hon. Manuel R. Gaerlan CDC President and CE0. One thing is clear and unrectified : the rights and interests of these ICCs/ IPs concerned have NOT been clearly RECOGNIZED, PROTECTED and PROMOTED, pursuant to the mandate of the IPRA LAW – R.A. No. 8371, to wit:

Based upon the above undisputed facts and developments, CDC and NCIP, in close association with their co-conspirators, manufactured a ROBOTdenominated SANGGUNIANG TRIBONG AETA OF CADT 025-A (STA), created under the NCIP “VOID” En Banc Resolution No. 07-127-2018, antedated August 14, 2018. The new Board of Commissioners had nothing to do with the passage and approval.

The NCIP can initiate two courses of action to rectify this flagrant injustice against the Tribong Aeta :

(1) Please cause the recall of the

and, as such, without legal force and effect.

(2) Please request Clark Development Corporation (CDC) to release the 20% SHARE OF TRIBONG AETA executed on December 6, 2007.
