A 42-year-old man from Barangay Tisa, Cebu City is facing charges before the court for allegedly raping his 11-year-old stepdaughter.

Associate Prosecution Attorney Jennifer Karen Alo-Leyson found enough evidence and held the suspect for trial for qualified rape.

“That on the basis of the evidence presented, there is a reasonable ground to believe that the crime qualified rape has been committed and that the accused is probably guilty thereof,” Leyson ruled.

The FREEMAN is withholding the names of the victim and the accused due to the nature of the case.

The suspect will not enjoy temporary liberty while the case is being heard since the state prosecutor recommended no bail for him.

The victim alleged that on several dates from May 2013 to May 2014, her stepfather raped her and threatened to kill her as well as her mother if she would divulge the matter.

The alleged rape, the girl said, happened at nighttime and at dawn.

Leyson sent subpoena to the suspect for him to answer the allegations filed against him, but it was returned because he was not at the area stated as his address.

Thus, the state prosecutor resolved the complaint based on the evidence presented.

“There being no controverting evidences adduced, these allegations sufficiently engender a finding of probable cause that respondent authored the aforesaid criminal acts,” she ruled. Manto/NSA
