NBI-7 arrests lawyer on Supreme Court order

The National Bureau of Investigat­ion (NBI)-7 arrested a 61-year-old Cebuano lawyer based on an order from the Supreme Court.

According to lawyer Donaver Inesin, the SC ordered the arrest of lawyer Marlon Cabilan for his failure to comment on acomplaint filed against him.

Inesin said that on July 16, 2012, SC ordered the NBI-7 to arrest lawyer Cabilan, a resident of Barangay Marigondon in Lapu-lapu City, but operatives failed to locate him. Inesin could not provide details on the complaint that Cabilan is facing because the SC order did not specify it.

However, in a resolution dated April 17, 2017, the SC ordered the reimplemen­tation of the order of arrest against Cabilan.

Inesin, the agent assigned to the case, said that through Facebook, she was able to locate Cabilan.

On January 23, 2018, at 2:30 p.m. she arrested Cabilan inside his office in Marigondon Beach Road in Lapulapu City.

After his arrest, Cabilan complied with the order of the SC to submit his comment on the complaint filed against him.

But since there was no release order from the SC, Cabilan remains under the custody of NBI.

A background check revealed that Cabilan has a pending case of estafa before the Regional Trial Court Branch 23 in Cebu City.

Judge Generosa Labra issued an arrest warrant against Cabilan last Monday because the lawyer did not show up during the promulgati­on of his case despite notice sent to him.

On Tuesday, Inesin brought Cabilan to the court and Labra issued a commitment order for Cabilanto be detained at the Cebu City Jail.

Inesin said she will send a letter to the SC to inform that Cabilan has another pending case and is detained at the Cebu City Jail.
